We are hereby pleased that you are interested in our company and are applying for a position offered in our company. Here in the following, we will provide all the required information on how we will process your personal data in connection with your application.

The protection of your personal data is of paramount importance. Personal data is information about personal or factual circumstances regarding an identified or identifiable natural person. The personal data include, for example, your legal name, address, phone number and date of birth, but also all other data which can be related to an identifiable person.

Our data protection practice is in accordance with the valid legal regulations, in particular those of the Federal Data Protection Act (BDSG, Bundesdatenschutzgesetz) and the General Data Protection Regulation of the EU (GDPR).

What kind of data shall be subject to our processing? And for what purposes do we process the data?

We process the data you have transmitted to us in connection with your application in order to check your suitability for the position (or any other open positions within our company) and to carry out the recruiting and hiring process. For this purpose, among other things, the following data of the applicant are processed: applicant master data, CV information, qualifications and certificates as well as, the data concerning the bank details (for the purpose of reimbursement of travel expenses) or, if needed, information on disability and/or on severe disability. In this context, the following processes are needed:

  • Transfer of applications starting from the e-mail function mailboxes,
  • Processing of the incoming applications sent per mail or per fax,
  • Creation of an overview of the incoming applications.

An automated profiling by the person responsible will not be carried out.

 

On what legal basis does the said processing take place?

The legal basis for the processing of your personal data included in the present application process is primarily the article 26 paragraph 1 of the BDSG in conjunction with the article 26 paragraph 8 sentence 2 of the BDSG in its version applicable starting from the date of 25 May 2018. According to the said version, the processing of the data required in connection with the decision made on the establishment of an employment relationship is allowed.
If the data is required for legal prosecution after the application procedure has been completed, the data processing may be carried out on the basis of the requirements under article 6 paragraph 1 letter c of GDPR, such as for the assertion or defence of claims.
The processing of the data transmitted by the applicant may also require the consent granted according to article 26 paragraph 2 of the BDSG in case an applicant is to be included in a pool of applicants for the purpose relating to a potential collaboration to happen in the future.

 

How long will the data be stored?

The data of the applicants will be deleted after a period of 6 months in case the said applicants are not hired.

In the event that you have agreed to further storage of your personal data, we will add your data to our applicant pool. Therein, your data will be deleted after a term of two years.

If you are hired in the context of the application procedure, your data will be transferred to our human resources data system starting from the data system of the applicants.

 

Who are the recipients who will receive my data?

Your applicant data will be reviewed by the human resources department upon receipt of your application. Inside the company, application documents are only made available to the persons who are directly involved in filling the respective position. At this point, all the suitable applications can be forwarded internally to the department which is responsible for the respective open position. Within the company, your data will be provided only to those persons who need it to ensure proper handling of our recruiting and hiring process. There is no data transfer to third parties, in particular not to another country outside Germany.

 

Where is your data processed?

The data is processed exclusively on the internal servers of the controller.

 

The rights granted to you as "data subjects"

You are entitled to information (under article 15 of the GDPR) about the personal data we process about you.
 In the event of a request for information which is not sent in writing, we will ask for your understanding that we may in this case request evidence from your side which proves that you are the person you claim to be.
 In addition, you are entitled to correction (under article 16 of the GDPR) or to deletion (under article 17 of the GDPR) or to restriction (under article 18 of the GDPR) of the processing, insofar as this is possible from a legal point of view.
IN ADDITION, YOU ARE ENTITLED TO OBJECTION (UNDER ARTICLE 21 OF THE GDPR) TO THE PROCESSING WITHIN THE FRAMEWORK OF THE LEGALLY APPLICABLE REQUIREMENTS. The same principle applies to a right relating to the data portability (under article 20 of the GDPR).
